Phoebe Lea is a Solicitor in the Commercial department, specialising in advising clients in the public sector.

Undertaking a broad range of work within the public sector team, Phoebe works with clients including NHS Trusts, public sector regulatory bodies, local authorities, schools, and Facilities Management companies. Phoebe assists clients on a range of matters including:

  • Large-scale commercial contracts, including Private Finance Initiative (PFI) and combined heat and power schemes
  • Interpretation and enforcement of contractual provisions
  • Dispute resolution through mediation, adjudication, arbitration, and court proceedings
  • Contractual negotiations
  • Regulation and statutory compliance and
  • Public procurement

Experience

Phoebe has experience with:

  • Advising in relation to the management and running of large-scale commercial contracts
  • Undertaking monitoring of contractual compliance on client sites across the country, including creating and implementing effective monitoring and reporting procedures and overseeing the maintenance of datasets tracking compliance
  • Assisting with dispute resolution in commercial contracts and major PFI schemes, including in relation to contractual non-compliance and termination
  • Applying contractual remedies including contractual tariffs and step-in provisions
  • Interpretation and enforcement of contractual provisions to ensure facilities management services are delivered to the required standards
  • Advising in relation to data management and record keeping to fulfil contractual requirements
  • Preparing effective and compliant contractual documents
  • Advising in relation to a wide range of contractual breaches and performance failures, including staff training, proper record maintenance, and site maintenance and lifecycle obligations and
  • Preparation of policies for use by public bodies, including on public procurement
