Stephen is a Partner in our Construction and Engineering team.

Stephen provides advice to clients regarding development/site/project issues including contract reviews and/or interpretation as well as advising on potential disputes.

This includes advice on dispute avoidance and either helping clients to resolve issues without the need for formal disputes or for resolving such disputes effectively if and when they arise.

Stephen is experienced in alternative dispute resolution procedures including mediation. He is experienced in all types of dispute resolution relevant to the Construction industry including litigation proceedings, arbitration and adjudication (both proceedings and subsequent court enforcement) as well as construction related insolvency.  As is common to the discipline, the subject matter of claim experience is varied including valuation disputes, interpretation of contracts, delay, defects, design issues, façade collapses, loss of profit.

Experience

  • Final account dispute for a football club in respect of their new stadium development involving three adjudications and a mediation (£3 million) covering issues surrounding failure to meet specification, defects, valuation and delay.
  • Acting on behalf of a housing and care provider in respect of arbitration proceedings in relation to care home defects claim relating to breaches of Building Regulations including in relation to firestopping (£6 million)
  • Arbitration proceedings relating to the construction of a hotel in Bognor Regis by the modular sub-contractor (£4 million)
  • Acting for a contractor in a claim against a developer in the Court of Appeal (Farrah & Anor v Rylatt & Ors [2019] EWCA Civ 1864)
  • London TCC proceedings in respect of a façade collapse during a redevelopment of a Grade II listed building in Bradford city centre (£6 million) including reported interim hearing on preliminary issues (Aldersgate Estates Ltd v HAM Construction Ltd [2013] EWHC 104 (TCC))
  • London TCC proceedings in respect of a defective concrete floor at a flour mill including business interruption claim in addition to remedial cost where it related to the company’s sole mill and storage facility (£1.5 million).
  • Lead more than a hundred sets of adjudication proceedings for developers, contractors, sub-contractors and consultants in respect of multifarious disputes.
  • Numerous sets of adjudication proceedings for a large contractor for various businesses thereunder and relating to multiple issues including delay, disruption, defects, interim valuations and final accounts with values from £50k to £1 million.
  • Lead successful defence of Part 8 proceedings relating to adjudication enforcement in the London TCC (Aecom Design Build Ltd v Staptina Engineering Services Ltd [2017] EWHC 723 (TCC))
  • Lead numerous sets of adjudication enforcement proceedings including 4MA Ltd (t/a 4M Group) v Nash [2019] EWHC 3760 (TCC)
  • Various disputes for an engineering company acting as sub-contractor for the design and installation of grille flooring to all levels of the redevelopment of the MacAllan Distillery and visitor centre both up and down the contractual chain.
