Matthew acts for claimants and defendants in disputes involving the administration of estates, will validity claims, proprietary estoppel disputes, property ownership disputes following a death, power of attorney disputes,  Inheritance Act claims, professional negligence claims in relation to wills and disputes involving trustees, personal representatives and beneficiaries.

Matthew has a strong reputation in this specialist field and is often instructed by professional executors and well know charities involved in disputes in relation to an estate.

Matthew is a member of the Association of Contentious Trust and Probate Specialists (ACTAPS) and the Contentious Trusts Association (ConTrA).

Experience

  • Acting for a claimant in a dispute involving a large farming estate in Cumbria. The estate included agricultural farmland, commercial premises and a number of holiday properties valued in excess of £8.5 million. The case was resolved at mediation with a  life-changing settlement sum for the client.
  • Acting for a defendant in a claim involving claims against his deceased father’s estate by his stepmother. The claim involved minor children and resulted in a settlement negotiated at mediation on favourable terms where the client retained a substantial share of the estate.
  • Advising a client in relation to a will validity challenge and the entry of a caveat against an estate involving property located in Spain and UK bank assets. The matter was resolved in our clients favour with all claims withdrawn following an application to remove the caveat.
  • Acting for a claimant in relation to an inheritance act claim for additional provision to be made available from her deceased father’s estate. The claim was resolved In client’s favour following judgement in the Leeds County Court.
  • A professional negligence claim against solicitors who prepared a will for an elderly client where there were doubts regarding capacity and where issues relating to the ownership of jointly owned property were not resolved prior to the testator’s death.
