Kieran has acted in a range of complex and high-value claims surrounding PFI, contract, negligence, statutory and construction-related insolvency disputes. He has represented clients in all dispute resolution forums, including adjudication, arbitration, mediation and litigation; predominantly in the Technology and Construction Court. Areas of dispute have included defective work and design, payment, loss and expense, variations, extensions of time and contract formation, including declaratory relief.
Kieran’s experience includes acting for:
- an NHS Trust in the first PFI default termination and associated dispute as to the estimated fair value of the project agreement
- a contractor in a £26 million dispute relating to the defective construction of a care home including claims under Building Safety Act 2022 and Defective Premises Act 1972
- a local authority as employer in a £14 million infrastructure dispute
- a nationwide residential housing provider in an eight figure professional negligence claim
- a client in a multi-million pound IT service contract dispute
- a subcontractor in the defence of a £1.2 million defective cladding system claim
Kieran is experienced in advising on and preparing a wide suite of construction documentation, including framework agreements, bespoke and industry standard forms of building contracts (JCT, NEC, FIDIC), professional appointments, collateral warranties, letters of intent and letters of reliance. His experience includes acting for:
- national housebuilders in relation to multi-million pound residential developments across the UK;
- local authorities, NHS trusts and education providers; and
- developers in relation to the construction of leisure and hotel chains across England
Kieran is also a founding committee member of the Forum for the Built Environment North East division.
