Kelly is a Partner in our social housing property team. She specialises in property and regeneration projects with an affordable housing focus, acting for regional and national registered providers, local authorities, public sector bodies and private sector developers.

Kelly has a wealth of specialist sector expertise, providing advice on the affordable housing elements of property development, including acquisitions and disposals at turn key and golden brick stage, development agreements, package deals, option agreements, overage, grant funding, s106 and infrastructure agreements, shared ownership and residential site set up, large scale stock rationalisation, refinancing and security arrangements and home ownership initiatives.

Experience

  • Acting for The Riverside Group in connection with its extensive development and property management programme (including acquisitions at turn-key and golden brick stage, land-led development agreements and acquisitions, package deals, extra care schemes, option and overage agreements, grant funding (AHP, SOAHP, HIF, LAAC, Strategic Partnership funding), nominations rights, s106 and infrastructure agreements, as well as its home ownership programme, including shared ownership set up, plot sales, RTA,RTB, staircasing and surrender and re-grant workstreams and its asset management function, advising on surplus land and stock disposals.
  • Advising Joseph Rowntree Housing Trust in connection with its development projects including acquisitions involving package structures, s106 and turn-key deals, as well as the development of JRHT-owned land including securing the re-location of and variation to rights benefitting existing tenants and community interest groups
  • Acting for Places for People Group in connection with their large scale stock rationalisation programme (both tenanted and untenanted surplus stock).
  • Acting for a Local Authority RP in connection with its £60m acquisition and development of 200 affordable housing units across six leasehold blocks from a developer, involving a complex leasehold structure, district heating system, s106 affordable housing obligations, GLA funding and inter-creditor step-in.
  • Acting for a Local Authority RP in connection with its proposed £2m acquisition and development of affordable units from a developer in London.
  • Acting for a regional RP in connection with land-lead package deals involving the delivery of 500+ units.
  • Acting for an extra care provider in connection with a number of its later living and extra care developments working in partnership with an RP as the end user and local authority as landowner
  • Acting for a local authority to prepare legal documentation for a competitive tender for the development of an extra-care and respite centre care facility, involving a development agreement, lease,  funding agreement and management agreement to a developer RP, plus building contract and collateral warranties.
