Who is Responsible for an E-Scooter Accident?

If an e-scooter has been ridden irresponsibly in a public space, for example, the rider was going over the maximum speed limit of 15.5mph, then the rider is likely responsible in the event of an accident.

Liability is dependent on the individual circumstances of the accident, and you should seek legal advice if you have been involved in a collision either when driving a vehicle or as a pedestrian.

What should businesses do now?

Many will have worked collaboratively with their suppliers and customers to deal with the immediate public health crisis. This will have meant offering flexibility as to contractual arrangements, whether in delivery dates, volumes of goods or services supplied, or even in the specification of what has been delivered.

If this is the case, it is important that businesses now do their legal housekeeping and make sure they have a proper record of what has been agreed. Unfortunately, our experience shows that many legal disputes arise out of amendments to contracts, typically where the parties to the contract each have a different view about what exactly they agreed to change.

We would therefore advise businesses to review any amendments that they might have agreed either verbally, by email, or otherwise, and consider whether they need to be captured in a more formal way which will make clear exactly what has been agreed to be varied, and (where appropriate) how long that variation will remain in force.

It’s also important to remember that some contracts contain provisions that set out specific requirements about how amendments are to be made. For example, they might require that amendments are made in writing (rather than verbally). These “No Oral Modification” clauses are commonly found in commercial contracts, and the courts have recently shown that they are willing to enforce them.

Failing to deal with amendments in accordance with contractual requirements could therefore have a serious impact on businesses as they recover from the disruption caused by the lockdown. If they end up in dispute with a customer or supplier, a business could find that the contract has not actually been amended in the way that they think – potentially leading to legal costs and liabilities at the worst possible time.

What impact does the Regulations have in respect of matters which arise from Fire Safety Audits - e.g. if balconies with wooden/decking elements are now considered higher risk and whether that would fall to developer to remedy the materials used to construct balconies?
The duty would fall on the owner of the building to control the hazards presented by balconies made from combustible materials. There may be scope (via warranties/indemnities or other terms) arising from the contract between the developer and owner for the owner to seek to recover the cost of remedial works.
Am I obliged to offer staff flexible furlough?

No, there is no obligation on employers to offer a flexible furlough arrangement to staff. Operationally, flexible furlough may not be appropriate for your business and equally, returning on a part-time basis may not be suitable for individuals already furloughed for various reasons. Concerns about returning to work part-time or at all should be considered on a case-by-case basis.

The CLC’s current advice to those carrying out works on site is to carry out your own risk assessment on each site and determine whether or not it is safe to continue to work in accordance with the Public Health England instructions and the CLC Site Operating Procedures.  If it is not possible to work in accordance with the above they should not work.

What is a pre-nuptial agreement?

A pre-nuptial agreement is a legal agreement made between two individuals before they marry. A pre-civil partnership agreement (or a pre-registration agreement) is a legal agreement made between two individuals who are planning to become civil partners. A pre-nuptial agreement can provide the benefits of transparency in relation to financial affairs, certainty as to how assets would be divided if the parties separate or divorce and protection for assets (such as inherited wealth or pre-marital property) from a later financial claim.

Pre-nuptial agreements therefore reduce the risk of there being uncertain, emotionally draining and financially costly court proceedings if the marriage does break down in the future.
