NHS and Public Law

Acting as we do for a large client base within the NHS, you can have confidence that we are conversant with all aspects of NHS law which may be relevant to the good management of NHS bodies.

Jeffrey Keeble, Jamie Martin, Kathryn Myers and Nicola Richardson, the partners in our Healthcare Unit, have between them more than 70 years’ experience advising NHS bodies.

We believe in using our experience by more directly assisting with the NHS, and where appropriate members of our healthcare team act as directors and secondees.

For example, one of our partners is a non-executive director of a PCT. In addition, one of our associates was a Public Governor at Gateshead Health NHS Foundation Trust.

The combined experience of our personnel ensures that we have a keen insight into the problems and opportunities facing NHS trusts, PCTs and the NHS in general.

We also have extensive experience of working on secondment with client organisations within the NHS.

Ward Hadaway has extensive experience of advising all types and configurations of NHS bodies on the statutory framework within which they operate and their powers under statutes, establishment orders, subsidiary legislation, directions, and NHS guidance and circulars.

We have sound knowledge of NHS operational and financial procedures and have advised in relation to arrangements associated with the establishment of Primary Care Trusts, NHS trusts, Foundation Trusts and NHS trust mergers as well as in relation to the dissolution of NHS bodies and dealing with residual liabilities.

We also have considerable experience of dealing with judicial review and of creating policies with a number of our NHS clients designed to minimise the risk of successful challenge by means of judicial review.
